Drytally is provided by Huiru Gao ("we", "us" or "our"). You can contact us at erchen735@gmail.com for support, contractual questions or privacy requests. These Terms apply to the Drytally iPhone app and this product website. Apple and other suppliers have their own terms for services they provide.
Please read these Terms and our Privacy Policy before using the app. The Privacy Policy explains data practices; accepting these Terms is not blanket consent to optional health access, notifications, photo access, advertising or any other separate processing. Those choices remain separate.
2. Eligibility and your choices
Drytally is intended for people who are legally able to enter this agreement. It is not directed to children under 17. If you are under the age of legal majority where you live, a parent or guardian must review and agree where required by law. Any higher age restriction in the App Store or local law also applies. The app does not encourage anyone to obtain or consume alcohol.
You do not need a Drytally account to keep a diary. You are responsible for your device, any Apple Account used for purchases, and the accuracy of information you enter. Do not provide us with another person’s sensitive information without a lawful basis.
3. What the app does
Drytally helps you record drinks, alcohol-free days, notes and selected photos, and view your own calendar, totals and patterns. Optional features include reminders, Apple Health writing, widgets, sharing and export. Some features require Pro. Availability depends on the version, device, permissions and purchase status.
Unlogged days are not the same as confirmed alcohol-free days. Counts, prices, calories and trends depend on your inputs and settings and may be estimates. You should check information before relying on it or sharing it.
4. Health and service limits
Drytally is a personal record-keeping tool, not a medical device, clinical assessment, treatment programme or emergency service. It does not diagnose alcohol dependence, determine whether drinking is safe, or replace advice from a qualified health professional. It makes no promise of sobriety, weight change, health improvement or any particular outcome.
Use professional medical advice when making decisions about your health or changing alcohol use. Do not delay seeking care because of information shown in the app. If there is an emergency, contact the emergency service available where you are.
5. Licence and acceptable use
Subject to these Terms and applicable App Store usage rules, you receive a personal, limited, non-exclusive, non-transferable licence to use Drytally on Apple devices you own or control. We retain the rights in the software, branding, design and other materials we provide. You retain rights in your own diary entries and other content.
Do not redistribute or sell the software, misrepresent its origin, interfere with service operation, circumvent purchase verification or use it unlawfully. Reverse engineering restrictions apply only to the extent allowed by law; nothing here removes rights that cannot lawfully be limited.
6. Free use, Pro and previews
The current free app allows recording and editing today and yesterday and viewing the calendar and core totals. Pro includes older-day editing, notes, insights and CSV/PDF exports, with additional features described on the purchase screen. The features and conditions shown before a purchase govern the offer you accept.
The app may provide a limited in-app preview measured by active use. An in-app preview does not itself buy a subscription, charge your Apple Account or create automatic renewal. Do not confuse it with an App Store introductory offer. If Apple offers a billed trial or promotional subscription, its duration, price after the offer and cancellation conditions must be shown before you confirm.
7. Purchases and prices
Pro may be offered as a one-week auto-renewable subscription or as a one-time Lifetime purchase. Apple displays the actual price, currency, applicable taxes, billing period and any offer available to you before confirmation. Website examples or local test prices do not override that purchase confirmation.
Apple handles payment through your Apple Account. We do not receive your payment-card number. A purchase takes effect only after successful platform confirmation; an unavailable product, cancelled prompt or failed transaction is not a completed purchase.
8. Renewal, cancellation and refunds
A weekly subscription renews automatically unless cancelled through your Apple Account subscription settings in time to prevent the next charge. Apple’s applicable subscription terms explain the renewal timing. Deleting the app, turning off reminders or contacting support does not cancel a subscription.
You can manage subscriptions in Apple settings. Cancellation normally affects future renewals; access during an already-paid period follows the applicable purchase terms. Requests for refunds can be made through Apple at reportaproblem.apple.com. This process does not exclude any mandatory rights or remedies available under the law where you live.
9. Lifetime access and restoring purchases
A Lifetime purchase is a one-time, non-consumable entitlement to the eligible Pro features for the supported lifetime of the Drytally service, subject to the purchase description and mandatory consumer rights. It is not a weekly subscription and does not auto-renew. It is not a promise that every future, separately offered product or service will be included.
Use Restore with the Apple Account that made the purchase. Restoration depends on the platform record, product availability and applicable sharing rules. If access does not match a valid purchase, contact support. We will investigate rather than require you to purchase again without checking.
10. Your records, device storage and exports
Your diary, notes, selected diary photos, profile and onboarding answers are stored on your device. A widget uses a shared container on the same device. The current app does not provide cross-device diary sync or our own cloud diary backup. We cannot recover a diary we do not hold.
Protect your device and consider available export and Apple device-backup options. Uninstalling the app or resetting its data may remove local records. An export sent to Files, email or another app is controlled by you and the receiving service. Apple Health copies and separately saved exports may remain after the app is deleted and must be managed in those destinations.
11. Permissions and third-party services
Health access, photo selection and notifications are optional and governed by your system choices. You can change permissions in iOS settings. Some integrations may stop working if permissions are refused or revoked; essential local diary use does not require all optional permissions.
Apple provides the App Store, purchase processing and optional system services. RevenueCat supports purchase validation, and our Cloudflare-hosted purchase service checks signed purchase proofs and receives authenticated purchase events, as explained in the Privacy Policy. Cloudflare also hosts this website. These services do not provide cloud diary sync. Third-party outages or restrictions may affect those services; we do not control their independent policies or platform decisions.
12. Updates and changes to the service
We may issue updates, correct errors or change features. We will give reasonable notice of material changes affecting paid access where required and respect applicable remedies for a service that no longer conforms to the agreement. We do not promise a particular update schedule or continued support for every older operating system.
We may update these Terms for changes in the service, security or law. The version and effective date appear on this page and in the app’s legal materials. Material changes will be brought to your attention as required. A revised notice does not retroactively authorise a new use of personal data.
13. Ending use or access
You can stop using Drytally at any time. Before deleting it, save any records you wish to keep and separately cancel subscriptions you no longer want. Ending use does not cancel an Apple subscription automatically.
We may restrict access to a remote service for material misuse, unlawful activity or security reasons where proportionate and lawful. We will provide notice and an opportunity to address the issue where appropriate. Local records do not become our property, and mandatory access, refund or consumer rights remain unaffected.
14. Warranties and responsibility
We aim to provide the service with reasonable care and skill. To the extent permitted by law, we do not warrant uninterrupted availability, perfect accuracy of user-entered records or fitness for a particular medical or personal goal. These qualifications do not remove statutory guarantees or remedies.
Nothing in these Terms excludes liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or other liability that cannot lawfully be excluded. Any restriction on indirect losses applies only where the law allows it. No provision requires you to waive mandatory rights as a consumer in the EEA, UK, United States or elsewhere.
15. Disputes and consumer rights
Please contact erchen735@gmail.com so we can try to resolve a problem. You remain free to use the courts, regulators and dispute-resolution procedures available under applicable law. These Terms do not impose mandatory private arbitration, a class-action waiver or an exclusive foreign court on consumers.
You retain any mandatory protections of the law of your habitual residence and any right to bring proceedings in a competent court. If a provision is unenforceable, the remaining provisions apply to the extent lawful; the invalid provision is not replaced by a rule that removes a mandatory consumer protection.
16. Apple-specific terms and contact
These Terms are between you and Huiru Gao, not Apple. Apple is not responsible for maintaining or supporting Drytally. To the extent required by the App Store terms, Apple and its subsidiaries are third-party beneficiaries of the applicable licence provisions. Apple’s standard Licensed Application End User License Agreement also applies where supplied with your download; mandatory platform and consumer rules prevail where applicable.
